Medical Malpractice

USClaims can help victims of medical malpractice by providing the money they need while their court cases are ongoing.

Among the more heartbreaking cases we see at USClaims involve medical malpractice cases with patients who thought they were going to a doctor or hospital to get better only to have their condition worsen. Making matters worse for the victim is the fact that not only has their health worsened, but the malpractice has rendered them unable to continue working.

Laws vary from state to state, but there are several varieties of medical malpractice that can result in a legal claim. By definition, medical malpractice results when a medical practitioner acts negligently, whether by their actions or inactions; this includes failure to diagnose an illness, misdiagnosis, failure to provide proper treatment, an unreasonable delay in treatment, or the failure to provide the “informed consent” of potential risks of a procedure, even if it’s performed effectively.

Medical errors can occur at hospitals, clinics, out-patient surgery centers, doctors’ offices, nursing homes, pharmacies and in patients’ own homes.

Common medical malpractice claims include wrongful death, misprescribed drugs, surgical errors, wrong-site surgery, birth injuries, gastric bypass problems, medication errors, wrong diagnosis and emergency room errors. According to the Journal of the American Medical Association, more than 225,000 people die annually due to medical errors, representing the third leading cause of death in America. The journal estimates 12,000 annual deaths from unnecessary surgery, 7,000 from medication errors in hospitals, 20,000 from other hospital errors, 80,000 from infections acquired in a hospital and 106,000 from non-error adverse effects of medications. Also, nearly one-third of doctors surveyed by the New England Journal of Medicine claimed that they or a relative had experienced medical errors.

Overall, the cost of malpractice to society is estimated between $17 and $29 billion in health care expenses, lost income, lost household production and other costs.

All the while, the number of medical malpractice claims has remained relatively steady.

A victim of medical malpractice has already lost faith in the medical profession as a result, but make no mistake about it: Pursuing these claims can be costly and time-consuming with many states employing “medical malpractice damage caps,” which limit the damages a victim can recoup. Not only is it important for a victim to find a good attorney to help them with their claim, but it’s also essential to have the financial backing to get the award you deserve.

That’s why USClaims works with medical malpractice victims. They’ve already been through enough pain. Why let financial constraints make matters worse?
